<p>Indonesia will experience a demographic bonus in the next few years. The government predicts that in 2045, the younger generation will reach its peak and this is a potential that must be properly maintained. In line with an international issue that has been ratified, namely children's rights, the government implemented a program called City/District Suitable for Children (KLA). Currently, not all regions implement KLA due to various factors, but the government's goal is clear enough to be able to grant this KLA status to every region throughout Indonesia. As of 2022, Probolinggo Regency does not yet have a legal umbrella for KLA, but it has planned the formation of laws and regulations to strongly prepare for this KLA. Through the juridical-normative method this legal void is analyzed using legal political theory. <p>The employment relationship is a relationship that occurs between workers and employers who bind themselves to each other through work agreements. The work agreement is the basis for the occurrence of a work relationship, whether it is carried out for a certain time or an unspecified time. Based on the provisions of Article 59 paragraph (4) of Law Number 13 of 2003 concerning Manpower, a work agreement for a certain time can only be implemented for a maximum of 3 years, and after that the status of an employment relationship by law becomes a work agreement for an indefinite time. The presence of the Job Creation Law changed the provisions of article 59 paragraph (4) of the Manpower Law which do not limit the timeframe for implementing contract work agreements. It is feared that the change in regulation will give workers the status of contract workers for life. The methodology used in this research is normative juridical research, using statutory and conceptual approaches. The purpose of this research is to look at the differences in legal protection for contract workers before and after the amendment to Article 59 paragraph (4) of Law Number 13 of 2003 concerning Manpower. After looking at the differences in legal protection for contract workers, do these changes provide better legal protection for normative rights for contract workers? The results of the study show that changes to the unlimited term of contract workers provide legal protection for the normative rights of contract workers which are not good, so it is necessary to conduct a judicial review to the Constitutional Court as a form of repressive legal protection for all levels of society, especially contract workers.</p>Giovani Marco TaraniSunarjo SunarjoAriyanti Ariyanti

<p><em>Different treatment of indigenous peoples can potentially lose traditional rights of indigenous peoples over their customary forests, thus having an impact on the difficulty of indigenous peoples obtaining natural resources from forests for their daily needs. The loss of these rights is sometimes done in an arbitrary manner, which often results in conflicts between customary law communities and rights holders. The problems discussed in this study are related to legal certainty regarding the recognition and designation of customary law community customary lands in the Minister of Agrarian Regulation/Head of the National Land Agency Number 18 of 2019 and the existence of customary lands after efforts to administer customary lands of indigenous and tribal peoples in Indonesia. The results of this study are that the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 18 of 2019 regulates the recognition of indigenous peoples and the granting of community rights and customary institutions, the area where customary rights take place, the relationship, linkage and dependence of customary law communities with their territory, as well as the power to jointly regulate land use in their respective territories. However, this recognition is not immediately binding because customary law communities still have to complete the constitutional procedures regulated in Article 5 to Article 17 of Regulation of the Head of BPN Number 10 of 2016 which consists of 3 stages. In addition to this, the recognition of the existence of customary land must also be accompanied by recognition of the existence of customary law community units by the local regional government. protect the existence of customary law community units that still exist in Indonesia. And the characteristics of customary rights of customary law communities, that customary rights over land are controlled by customary law communities, namely people who live in groups, for generations based on ties of origin/ancestry or similarity of residence, have the same culture, live in a certain area, have property customary objects that belong together, have customary institutions containing sanctions, as long as they are still in accordance with developments and do not conflict with national law. The Indonesian Constitution explicitly mentions recognition of the unity of customary law communities, specifically in Article 18B paragraph (2) and Article 28I paragraph (2), so it should be. Meanwhile, data from the Agrarian Reform Consortium (KPA) states that from 2005 to 2022 there were 4,009 structural agrarian conflicts covering 11.4 million hectares of land and affecting 2.4 million people. This has the potential to result in the alienation of indigenous communities from their traditional territories, where based on Law Number 21 of 1999 this action is a form of discrimination against traditional jobs of indigenous peoples. This article analyzes the influence of government policies in the field of agrarian law on the territorial rights of indigenous peoples and the implementation of the principles of Free, Prior, and Informed Consent in Indonesia. This research uses the normative legal research method, the statute approach method. Referring to Law Number 6 of 2023 concerning Job Creation, one of the objects of regulation is Article 87 of Law Number 6 of 2014 concerning Villages, where the Law is the legal basis for establishing BUM Desa in Indonesia. BUM Desa is regulated as a legal entity, so it requires professional management and accountability and applies the principles of good corporate governance so that BUM Desa can play a role in accordance with the mandate of the Village Law. In this regard, one BUM Desa that is growing quite rapidly in Malang Regency is BUM Desa ARMADA owned by Palaan Village, Ngajum Sub-district, Malang Regency. However, it cannot be denied that its management still has some problems. This study aims to determine how BUM Desa Armada conducts management and accountability of BUM Desa management in accordance with the general principles of good corporate governance and is legally analyzed. The results showed that BUM Desa Armada still needs a strategic and inclusive arrangement regarding strengthening human resources, BUM Desa management, selection of types, and business units to accountability in the field of business results. One form of utilizing digital technology and the internet in the economic sector for two-dimensional works of art is through Non-Fungible Tokens (NFT). NFT is a form of digital asset in the art sector, where transactions are usually carried out on a special platform. This article examines the protection of creators' exclusive rights from the tokenization of their work by other parties as well as the responsibilities of NFT Marketplaces. <p>Cultural heritage is one of Indonesia's wealth that must be maintained and preserved by all components of the nation. Law Number 11 of 2010 concerning Cultural Heritage strengthens efforts to protect and preserve cultural heritage by regulating criminal offences committed against cultural heritage, including cultural heritage destruction. However, investigating criminal offences of destroying cultural heritage sites is inseparable from various problems that can slow down its completion. Therefore, regulating the expiration of the investigation period for cultural heritage destruction is necessary. This research is normative-empirical, in which data is obtained through a literature study and interviews with investigators from the Region X Cultural Preservation Centre. From the research results, it was found that the investigation of the cultural heritage sites destruction still has many obstacles faced. Presidential Regulation Number 86 of 2018 as the basis for implementing Agrarian Reform states that access management is providing opportunities for access to capital and other assistance to subjects of Agrarian Reform in order to improve welfare based on land use, which is also called community empowerment. The National Land Office of Deli Serdang Regency has Pematang Johar Village, which is used as the location for a land-based community empowerment program. Agricultural land in Pematang Johar Village is used as a living asset and becomes the basic capital of the community to improve welfare and to realize an increase in per capita income for recipients of access to agrarian reform. This research analyzes the form of technical activities for asset management and access to agrarian reform. So it will provide an overview of the form of land-based community empowerment that has been implemented by BPN Deli Serdang Regency. The method used is a conceptual approach with case studies in descriptive form that analyze the implementation of access reform. Based on the research results, Pematang Johar Village in Deli Serdang Regency is an area designed as an "Agrarian Reform Village" and designated as a pilot project with a reform access model in the form of corporate farming. Technically, the Agrarian Reform Access Arrangement activity uses an empowerment strategy approach that is based on an analysis of social mapping, problems, potential, situation, and direction of needs that will be the target of community land distribution activities.Onny MedalineIda NadirahMuhammad Syukran Yamin Lubis

<p><em>The overcapacity of prison in Indonesia has been a problem in Indonesia’s law system. Restorative Justice is one of the solutions that the law maker and officers in the law system offer to the society. Ironically, restorative justice has not been regulated properly in the criminal procedural law but only in the law No. 11 of 2012 about Juvenile Justice System. The application in general is regulated seperately by three different legal subsystems, namely Police, Prosecutor, and Supreme Court. The unharmony of the regulation without a standing regulation shows the absent of the certainty of law. This paper will use normative legal research with </em><em>statutory and conceptual approach to analyze current regulation and legal vacuum (rechtsvacuum) in restorative justice as part of criminal procedural law.
