Review of Law No. 24 of 2007 Concerning Disaster Management and Government Regulation No. 7 of 2018 Concerning Provision of Compensation, Restitution, Assistance to Witness and Victims
Abstract
This article is motivated by an incident of a tear gas shooting at a football match at the Kanjuruhan stadium, Malang, which was carried out by a joint police force. This incident until October 2022 has killed 135 people and there are still moderate injuries, as well as minor injuries. This article aims to examine and analyze the regulations and policies that regulate government compensation or compensation in cases of riots and the application of compensation. The method used is a normative legal research method because it will examine the legal regulations and policies that regulate the provision of compensation to victims of riots in the community, in this case, the Kanjuruhan case. The results show that there are regulations that review the provision of compensation in the event of a riot, namely Law Number 24 of 2007 concerning the provision of compensation, restitution, and assistance to witnesses and victims and Government Regulation Number 7 of 2018. Furthermore, currently, the child's heirs have not received compensation from the local government and central government. The assistance that has been received by the child's heirs is a deposit from the Malang Police Chief as a scholarship until graduating from high school (High School). In addition to compensation, the victim's heirs also need psychosocial rehabilitation for their health and mental stability.
